Labor and Employment Counsel (Job Number: 191870W-01)
DuPont Legal, located in Wilmington, Delaware, has a Labor and Employment Counsel position available. This Position requires a person of vision, integrity and commitment, as well as substantial leadership and influencing experience, maturity and judgment. The role of the Labor and Employment Counsel is to provide legal services as a partner to the Company’s business teams and assist those teams in achieving their goals and the goals of DuPont in the context of applicable laws and regulations related to the employment relationship, the competitive environment, Company values, and shareholder expectations. The successful candidate will serve as counsel for business operations across the U.S. and act as a coordinating resource for significant international employment law and human rights issues. He/she will also serve as a key liaison with national outside labor and employment counsel, and work collaboratively with outside counsel to address needs for legal services.
Responsibilities of the position include, but are not limited to:
Routinely interface with seniormanagement and management of businesses and functions to deliver businessspecific legal services.
Review documentation and data todetermine potential legal risks of a full range of employee relationsmatters, including, but not limited to, labor relations (including within aunion environment), employee terminations, employee non-compete questions,reductions-in-force, wage and hour issues, and discrimination anddisciplinary matters. Provide high quality legal advice and counseling basedupon sound legal judgment and analysis as well as consideration of practicalneeds of the business. Develop defenses to legal claims in employmentdisputes. Influence corporate infrastructure, policies, and practicesas appropriate. Assist the corporation in developing frameworks forboth legal and business analyses.
Advise on requirements andimplications of wide variety of laws and regulations, including but notlimited to the following: NLRA, ADA, ADEA, FLSA, ERISA, FMLA, TitleVII, and employment-related state statutes.
Drive the proactive developmentand implementation of employment risk management strategies, includingemployee training programs, complaint investigation procedures and practices,and alternative dispute resolution.
Stay abreast of legal and businessdevelopments and monitor for potential legal risks.
Review and draft company policiesand procedures ensuring they comply with applicable law.
Conduct investigations and legalanalysis by reviewing documents, interviewing witnesses, and obtainingevidence to determine legal risks to the Company or business.
Engage in personal andprofessional development, including through attendance at CLE seminars asappropriate.
To be qualified for thisrole, you must possess the following:
Atleast six to eight years of corporate and/or law firm experience, with aconcentration in labor and employment law.
Willingnessto travel and frequently work extended hours.
Thorough,balanced grasp of state and federal laws and regulations.
Abilityto collaborate effectively with outside counsel.
Strongcommunication and negotiation skills.
Abilityand skill to arrive at practical recommendations that balance legal riskwith business needs.
